Rules of internal regulations for persons who attend additional adult education programs in the Educational Center of the State Institution Republican Scientific and Practical Center of Pulmonology and Tuberculosis

1. General provisions

1.1        These rules of internal regulations for persons who attend additional adult education programs (hereinafter the Rules) in the Educational Center of the State Institution Republican Scientific and Practical Center of Pulmonology and Tuberculosis (hereinafter the Educational Center of the RSPC) have been developed in accordance with the norms established by the Constitution of the Republic of Belarus, The Labor Code of the Republic of Belarus, the Code of the Republic of Belarus on Education and other normative legal acts.

1.2        The purpose of the Rules is to strengthen the academic discipline, improve the quality of the educational process in the Educational Center of the RSPC.

1.3        The Rules apply to the persons enrolled in the established manner in the list of trainees for the additional adult education programs of the Educational Center of the RSPC (hereinafter, unless otherwise instructed).

1.4        The Rules are posted on the information stand of the Educational Center of the RSPC and on the Internet.

1.5        The organization and implementation of the educational process in the Educational Center of the RSPC is carried out in accordance with the current legislation of the Republic of Belarus.

2. Rights and duties of trainees

2.1        Trainees have the right to:

- Obtain education in accordance with educational programs for additional adult education;

- Life and health protection during the educational process;

- Be provided a place to live;

- Receive paid services in the field of education;

- Use library, educational, production and scientific base of the RSPC for free;

- Receive social, pedagogical and psychological assistance from the specialists of the RSPC;

- Get acquainted with a special permit (license) for educational activities, certificates of state accreditation, educational and program documentation;

- Participate in trade unions, youth and other public associations, whose activities are not contrary to the law.

2.2        Other rights of trainees are established by other legislative acts, constituent documents and other local normative legal acts of the Educational Center of the RSPC.

2.3        Trainees are required to:

- Comply with the requirements of the constituent documents, the Rules, other local normative acts of the Educational Center of the RSPC;

- Conscientiously and responsibly treat the content of additional adult education programs;

- Acquire theoretical knowledge and practical skills in the specialty in accordance with the requirements of the professional development training programs;

- Attend classes, carry out all types of assignments provided in the training documentation in time;

- Develop skills to independently obtain knowledge and widely use it in practice;

- Rationally and effectively use education time;

- Respect the honor and dignity of other participants of the educational process (including the teaching staff);

- Participate in public life and socially useful work, render all possible assistance to teachers in maintaining discipline and order in the education process;

- Take care of one's health, strive for moral, spiritual and physical development and self-improvement;

- Be organized, show an example of discipline, courtesy and high culture of behavior in the Educational Center of the RSPC;

- Take care of the property of the RSPC;

- Comply with the rules of labor protection, fire safety, industrial sanitation and occupational health.

2.4        Other duties of trainees are established by other legislative acts, constituent documents and other local normative legal acts of the Educational Center of the RSPC.

2.5        Trainees are prohibited to:

- Distract oneself and other trainees’ attraction during educational process;

- Make and receive calls during classes;

- Bring and take food in the audience;

- Spoil the furniture, equipment and interior of the audience;

- Spoil the security and fire alarm systems, evacuation schemes in case of fire and primary fire extinguishing means, other property of RSPC;

- Attend the RSPC in state of alcohol, narcotic or other forms of intoxication;

- Perform work that is not included in the educational process;

- Skip classes without good reason;

Smoke and drink spirits in the buildings of the RSPC or on its territory.

3. Responsibilities

3.1        The trainee is responsible for:

- Conscientious and responsible attitude to the content of additional adult education programs;

- Compliance with the requirements provided for in the constituent documents, the Charter of the RSPC, the Rules, rules of residence in the provided places and other local normative legal acts of the Educational Center of the RSPC;

- Performance of all types of educational work, included in the training and educational program documentation;

- Careful attitude to the property of the RSPC;

- Compliance with the rules for working with devices, equipment;

- Reliability of information on the trainee’s card.

4. Grounds for bringing trainees to disciplinary liability.Disciplinary actions

4.1        The grounds for bringing trainees to disciplinary liability are: unlawful, guilty (intentional or inadvertent) non-performance or improper performance of the duties assigned to trainee by legislative acts, constituent documents and other local normative legal acts of the Educational Center (disciplinary offense), in the form of the following acts (or inaction):

- Absence from training sessions without valid reasons;

- Violation of discipline during the educational process;

- Non-fulfillment of the lawful requirements of the teaching staff without valid reasons;

- Insulting of other participants of the educational process;

- Dissemination of information that is harmful to the health of trainees;

- Causing damage to buildings, structures, equipment or other property of the RSPC;

- Non-compliance (or violation) of the requirements of the legislation on health care, fire safety;

- Drinking alcoholic beverages, low-alcohol beverages or beer, using narcotic drugs, psychotropic, toxic or other intoxicating substances in the buildings of the RSPC, places of residence provided for the time of the educational process and on other territories of the RSPC; appearance in places mentioned above in state of alcohol, narcotic or toxic intoxication;

- Smoking (consumption) of tobacco products in the buildings of the RSPC, places of residence provided for the period of education and on other territories of the RSPC;

- Other illegal actions (or inaction).

4.2        Disciplinary liability is established for the disciplinary offense committed by the trainee, and is expressed in the application of disciplinary measures to him/her:

- Remark;

- Reprimand;

- Exclusion.

4.3        Exclusion as a measure of disciplinary liability may be applied for:

- Prolonged absence from classes without valid reason (in accordance with paragraph 2 of Article 128 of the Code of Education of the Republic of Belarus);

- Systematic (not less than two times during the educational period) non-performance or improper performance of duties of trainees if disciplinary measures were applied earlier.

4.4        The right to choose the measure of disciplinary punishment belongs to the Director of the RSPC. When choosing a disciplinary measure, the severity of the disciplinary offense, the reasons and circumstances under which it is committed, the previous behavior of the trainee should be taken into account.

4.5        A trainee, who is being brought to disciplinary liability, has the right to:

- Get acquainted with all materials confirming the guilt of the trainee and make copies of it;

- Provide explanations and present evidence or refuse to provide explanations;

- To be heard in any proceedings affecting his/her interests, to attend it;

- Receive legal assistance in accordance with the law;

- To get acquainted with the order on application of measures of a disciplinary punishment and to receive its copy;

- Appeal against the order on application of disciplinary measures.

5. The procedure for the application of disciplinary measures

5.1        The reasons for bringing the trainee to disciplinary liability may be: reports of local executive and administrative bodies, law enforcement agencies, other state bodies and organizations, reports of pedagogical staff and other employees of the Educational Center of the RSPC.

5.2        Before a disciplinary punishment is applied, the Director of the RSPC is obliged to request an explanation from the trainee in writing. If the trainee refuses to provide an explanation, it shall be recorded within an act, signed by three persons from among the employees of the Educational Center and (or) the trainees.

5.3        The trainee’s refusal to provide an explanation in writing doesn’t preclude the application of disciplinary measures.

5.4        Only one disciplinary measure may be applied for each disciplinary offense.

5.5        The decision to apply a disciplinary measure to the trainee is made on the basis of materials containing actual evidence of commitment of a disciplinary offense.

The Director of the RSCP has the right, and on the initiative of the trainee, who is being brought to disciplinary liability, is obliged to personally hear explanations, statements and complaints of the trainee.

5.6        The decision to apply the disciplinary measure to the trainee shall be formalized by the order of the Director of the RSPC, which should contain information about the trainee, who is being brought to disciplinary liability, the evidence of his guilt, and the indication of the disciplinary punishment measure.

The order of the Director of the RSPC on the application of disciplinary punishment is announced to the trainee under the signature within three calendar days. A trainee who is not acquainted with the order on the application of disciplinary punishment is not regarded as a subject of disciplinary liability. The refusal of the trainee to get acquainted with the order shall be recorded within an act, signed by three persons from among the employees of the Educational Center of the RSPC and (or) the trainees.

5.7        The decision to apply a disciplinary measure to the trainee may be appealed by him/her to a higher organization or court within one month.

5.8        The trainee is not regarded as received a disciplinary punishment, if he/she will not be brought to disciplinary liability again within one year from the date of application of the disciplinary measure. In this case, the disciplinary measure is automatically cancelled without issuing an order.

5.9        The Director of RSPC has the right to cancel the disciplinary measure ahead of schedule on his own initiative or at the request of the trainee. Early termination of disciplinary punishment is formalized by issuing order.
